Farmer Heroes Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED.

1. How To Enter: Enter the Sweepstakes at www.farmaid.org/farmerheroes. No other method of entry will be accepted. One entry per person. All eligible entrants must have a valid e-mail address to participate in the Sweepstakes. The sweepstakes will begin on May 14, 2008 and will run until September 2, 2008 at 9am EST.

2. Eligibility: This Sweepstakes is offered only in the United States and is open to legal U.S. residents, 18 years of age and older, with a valid e-mail address. Employees of Sponsor (as defined below) and its affiliated companies, advertising and promotion agencies, and the immediate families (spouses, and parents, children and siblings, and each of their respective spouses) and persons living in the same households as such individuals are ineligible. This Sweepstakes shall be construed and evaluated according to United States law. Void where prohibited or restricted by law. Entrants who enter the Sweepstakes more than once will be disqualified.

3. The Sweepstakes: In the entry process at farmaid.org/farmerheroes, entrants can upload a photograph and enter a description of approximately 150 words about their Farmer Hero. Entrants can also enter to win by entering their email address alone. The Grand Prize winner will be randomly drawn from all entries received at 9:00am EST on September 2, 2008. All eligible entrants, other than the Grand Prize Winner, will be entered into a random drawing for additional prizes.

4. Prizes: Grand Prize: There will be one Grand Prize winner who will win round trip coach class airfare for four (entrant and their Farmer Hero) from the major continental U.S. airport nearest the Winner's home to Farm Aid 2008 presented by Whole Foods Market and Horizon Organic, departing on or about September 19, 2008; hotel accommodations the night of the concert (two standard hotel rooms, double occupancy rooms for one night); and four front row tickets to Farm Aid 2008 (seats chosen by Farm Aid). Approximate retail value: $3,000. Fifteen additional winners will be selected in a random drawing for each of the following prizes: (1) a VIP gift bag for Farm Aid 2008 (5 winners chosen) (approximate retail value: $200); and (2) a 2008 Farm Aid concert t-shirt, choice of size (10 winners chosen) (approximate retail value: $25). Grand Prize Winner and travel companions must be available to travel on the same itinerary, as selected by Farm Aid. Ground transportation, food, beverages, in-room charges (e.g., mini-bar, movies), telephone calls, gratuities, incidentals, and all other expenses are not included. Prizes are non-transferable. No substitution or cash equivalent of any prize will be given. All taxes are the sole responsibility of the winners.

5. Sweepstakes Period and Winners: The Sweepstakes begins on May 14, 2008 and is subject to end without notice at any time in Farm Aid's sole discretion but no later than September 2, 2008 at 9 am EST when the random drawing for a winner will take place. When the Sweepstakes closes, the Grand Prize Winner will be chosen on September 2, 2008 at 9 am EST. On that same date, fifteen additional prize winners will be drawn from a random drawing among all eligible entries received by Sponsor, whose decisions are final. Odds of winning Grand Prize depend on the number of eligible entries received. Odds of winning additional prizes depend upon the total number of eligible entries received. Each winner will be notified shortly after selection but in no event later than September 4, 2008. A list of winners will be available on the Sweepstakes web site at www.farmaid.org/farmerheroes or can be obtained by sending a written request to Member Services, Farm Aid, 11 Ward Street, Ste 200, Somerville, MA 02143.

6. Notification of Winner/Claiming Prize: All winners will be notified by e-mail only and have up to 5 days to claim their prize via an e-mail reply, stating their name, address, city, state, zip, home phone number and/or work phone number. If selected winner does not claim his or her prize via an e-mail reply within 5 days from being notified of his or her selection as a winner of the Sweepstakes, the prize will be forfeited. No alternative winners will be selected. The Grand Prize Winner, his/her travel companion(s) and his/her Farmer Hero will be required to sign and return an affidavit of eligibility and release of liability.

7. Representations and Warranties: Entrant represents and warrants that: (i) he/she is the sole and exclusive owner of all rights to the photograph submitted as part of the entry process, including without limitation all copyrights therein, and the photograph is free of any adverse claim by any person or entity; (ii) the submitted description of approximately 150 words about his/her Farmer Hero is original to entrant; and (iii) the photograph and description will not violate or infringe upon the copyright, literary, privacy, publicity, trademark, service mark or any other personal or property right of any person or entity and will not constitute a libel or defamation of any third party. Entrant and each individual appearing in the entry photograph grants to the Sponsor a worldwide, royalty-free, non-exclusive, sublicensable, unconditional, perpetual and transferable right and license to use the photograph for any advertising, promotional or commercial purposes, including without limitation, the right to publicly display, perform, reproduce and distribute the photograph in any media format or medium and through any media channels (now known or hereafter developed). Entrant hereby agrees to defend, indemnify and hold harmless the Sponsor and its present and future parents, affiliates, subsidiaries and related companies, and the officers, directors, employees, representatives, agents, and advertising and promotion agencies of each of the foregoing, against any and all third party claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses, arising out of or related to any breach by the entrant of any provision of this document, including, without limitation, entrant's representations and warranties.

8. Additional Terms: By participating, entrants agree: a) to these Official Rules, and the decisions of the Sponsor, which shall be final in all respects; and b) to release, discharge and hold harmless Sponsor and its present and future parents, affiliates, subsidiaries and related companies, and the officers, directors, employees, representatives, agents, and advertising and promotion agencies of each of the foregoing, from and against all claims or damages arising out of their participation in the Sweepstakes and the acceptance, use or misuse of a prize. By accepting a prize, winners agree, where legal, to the use of their names and/or likenesses, for advertising purposes without compensation. Sponsor reserve the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or web site; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. All entry submissions shall become the property of Sponsor, and shall not be acknowledged or returned.

9. Limitations of Liability: Sponsor shall not be responsible for any incorrect or inaccurate information, whether caused by web site users or by any of the equipment or programming associated with or utilized in the Sweepstakes; any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access of the web site; any injury or damage to participants or to any other person's computer(s) related to or resulting from participating in this Sweepstakes, or downloading materials from or use of the web site. If, for any reason, the Sweepstakes cannot be conducted as planned by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which, in the sole opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify, or suspend this Sweepstakes or any drawing(s) and may select the winner from among all entries received for that drawing prior to the action taken. In no event will the Sponsor or its present and future parents, affiliates, subsidiaries or related companies, or the officers, directors, employees, representatives, agents, or advertising and promotion agencies of any of the foregoing, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of access to and use of the web site www.farmaid.org or the downloading from and/or printing material downloaded from said site. Without limiting the foregoing, everything on the site is provided "as is" without warranty of any kind, either expressed or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow the limitations or exclusions of liability for incidental or consequential damages, or exclusion of implied warranties so some of the aforementioned limitations or exclusions may not apply. Check local laws for any restrictions or conditions regarding these limitations and/or exclusions.
